These blenders are Vita-Mix 5000, Vita-Mix 5200, Vita-Mix 4500 Turbo, Blendtec HP3A, Blendtec Connoisseur, and Blendtec ICB 7 20 AMP Commercial Smoother made for the residential market.
Information about Price-Fixing and 123Vita, LLC. incentive program to participate in our Consumer Lifestyle Surveys in respect to blender usage:
The payment of $20 is strictly for the participation of the survey and is meant to be an incentive and compensation for participating in these surveys. Only one per household. Neither Vita-Mix nor Blendtec are associated to this survey activity or any compensation. We are not allowed to advertise any of the brand new blenders for less than manufacturers suggested retail price. But manufacturers cannot dictate the final sales price. According to the Commerce and Trade Commission of the United States, price fixing is illegal.
If manufacturers believe that we are giving a discount (which we are not) towards the purchase of any of their blenders, and object to our survey incentive program, then we can also logically argue that they are intending to manipulate free enterprise and therefore attempt to fix the retail selling price. Manufacturers cannot dictate the final sales price or the payment of any associated surveys as such is. Manufacturers have tried before to stop us from having consumers participate in surveys for which they are compensated. We believe that the time of the consumer has value. It takes all together about 10 minutes to fill out both surveys.
The $20.00 payment for the survey participation is therefore a compensation and the incentive to fill out the surveys, and cannot be construed by purchasers, competitors, participants, manufacturers, etc. as a cash discount towards the blender purchase. Obviously it is necessary for us to know who purchased a blender as part of the research data validity. Therefore we need to know that the persons have purchased a blender truthfully and also what models. If we don't know that, or if participants make up a blender purchase up to get the $20 for compensation, we will not pay out any survey participation compensation because there is no other evidence that a blender is really in that household.
The only way to assure accuracy of the data is to be able to cross reference it with the actual sales data of a blender. Since manufacturers are not willing to give us access to their customer database, we have to build our own database of blender consumers. If we find that manufacturers are complaining about this form of survey participation compensation, we will be happy to turn the matter over to the Commerce and Trades Department for investigation of Price Fixing.
Sincerely,
Thomas Fox
